PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THIS PROMOTIONAL PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AiGREE, DO NOT PARTICIPATE IN THIS PROGRAM.
Joining the Program
This program is not targeted towards, nor intended for use by, anyone under the age of 18. To enroll in our Program, you must first collect a physical Loyalty Card. Cards are available for free in our coffee store ("Store") in London (5 Upper St Martin's Ln, London WC2H 9NY) and are activated at the time of first purchase. The activation process may require that you provide to our baristas the following information: first and last name, birthday, e-mail address and gender. Your Card can only be activated in the name of an individual and only one. Card is issued by, and remains the property at all times of Coffee Island.
Using your Card - earning and redeeming points
By presenting and scanning your Card at our Store at the time of any purchase, you will earn one (1) point ("Point"). Card holders who earn ten (10) Points are entitled to a complimentary coffee beverage or 100g of freshly ground coffee from our Store. You can redeem only one voucher per transaction. You can check the Points balance of your Card at our Store. In order to redeem points, you have to present your Card to our baristas at the Store and state that you would like to redeem your Points. You cannot redeem or exchange your points for cash (including as part payment for any purchases at Store). Points are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others. To maintain all benefits of the Program, you must earn at least one (1) point during each consecutive week following your enrollment date. If you do not earn at least one (1) new point in each week, your point balance will automatically reset to zero (0).
Expiry and Termination
Loss, theft, damage
Coffee Island is not held responsible for any lost, damaged or stolen Cards. If your Card is lost, stolen or damaged, you can ask for a replacement Card at our Store. Every endeavor will be made to ensure that the full points balance is also transferred to the new card; however, Coffee Island will not be responsible for any points accrued that are lost in the transfer. Cards that are reported as lost or stolen will immediately be cancelled and will be no longer able to be used. We reserve the right to charge a replacement Card fee for each replacement Card in the event that you are issued with more than 2 replacement Cards within any 6 month period.
Cancelation and Termination of Program
We reserve the right to cancel, terminate, or suspend the Program at any time in our sole discretion, upon reasonable notice. Upon cancelation, termination or suspension of the Program, you may not earn additional Points, and the available points balance in your Card shall expire immediately.
The certain personal information you may provide to us, including your first and last name, e-mail address, birth date and gender could reasonably be used by us as permitted by and in accordance with applicable data protection law, to : (i) identify you and enable you to use your card; (ii) send promotional and marketing communications to you regarding us and our products and services; (iii) data share with our affiliates, business partners and market research companies to conduct market research and analysis about our Store and service on our behalf; (iv) send newsletters, updates and e‐mails; (v) create personalized content, offers, services, and advertising; (vi) support any other intended purpose stated at the time at which your information is collected, subject to any preferences which you may have indicated; (vii) prevent fraudulent transactions and theft; and (viii) comply with applicable law, governmental request, court order, or otherwise protect the rights, property, or safety of us or others.
By participating to our Program you acknowledge and consent to us using your information in those limited circumstances and for the purposes described.
We maintain strict security protocols, including physical, electronic and procedural safeguards, to protect Customer Information. These protocols include compliance with the requirements of the Data Protection Act to prevent any loss, misuse, unauthorized access, disclosure or destruction of your personal information. Although we strive to maintain data security, we do not guarantee or warrant its security.
Coffee Island shall not be liable for any loss or damage arising from or in connection to use of Card, outside of reasonable control, including but not limited to, failure of network services and failure of data processing systems. We reserve the right to refuse to accept a Card or to limit the use of a Card which it deems to have been tampered with, duplicated, damaged or which otherwise is suspected to be affected by fraud, misconduct or unauthorized use. We may, at our sole discretion, withdraw or cancel your Card or take any other action it may deem appropriate if it suspects fraud, misconduct or unauthorized use of your Card. The Card shall become invalid once cancelled and you will not be able to redeem the balance on your Card.
Your rights as a consumer
Nothing in this Agreement will affect your legal rights as a consumer. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards Office.
These Terms shall be governed in all respects by the laws of England and any disputes will be subject to the exclusive jurisdiction of the courts of England.
